Terms of Use

1. Your Acceptance

A. By using and/or visiting this website (collectively, including all Content available through the jamuse.com domain name, the "jamuse Website", or "Website"), you signify your agreement to (1) these Terms of Use, (2) jaMuse’s Privacy Policy, and (3) jamuse's Community Guidelines. If you do not agree to any of these Terms of Use, the jamuse Privacy Policy, or the jaMuse Community Guidelines, please do not use the jamuse Website.

B. Although we may attempt to notify you when major changes are made to these Terms of Service, you should periodically review the most up-to-date version. jamuse may, in its sole discretion, modify or revise these Terms of Service and policies at any time, and you agree to be bound by such modifications or revisions. Nothing in this Agreement shall be deemed to confer any third-party rights or benefits.

2. jamuse Website

A. These Terms of Service apply to all Members of the jamuse Website, including Members who join the jaMuse community, create a profile, upload images, video, audio, presentation and/or other digital asset files, contributor to blogs, forums, and/or other online discussions/postings, share, send, or transfer files, send or receive jamuse private mail box messages, collaborate files, store files, and/or use or participate in the use of other online features of jamuse.

B. The jamuse Website may contain links to third party websites that are not owned or controlled by jaMuse, including links to individual jaMuse member websites. jamuse has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, jamuse will not and cannot censor or edit the content of any third-party site. By using the Website, you expressly relieve jamuse from any and all liability arising from your use of any third-party website.

C. Accordingly, we encourage you to be aware when you leave the jamuse Website and to read the terms and conditions and privacy policy of each other website that you visit.

3. jamuse Accounts

A. In order to access some features of the Website, you will have to create a jamuse account (i.e. join). You may never use another's account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify jamuse immediately of any breach of security or unauthorized use of your account.

B. Although jamuse will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of jamuse or others due to such unauthorized use.

4. General Use of the Website -- Permissions and Restrictions

jamuse hereby grants you permission to access and use the Website as set forth in these Terms of Service, provided that:

A. You agree not to distribute in any medium any part of the Website, including but not limited to Members Submissions (defined below), without jamuse’s prior written authorization.

B. You agree not to alter or modify any part of the Website, including but not limited to jamuse's embedded file view or any of its related technologies.

C. You agree not to access Member Submissions (defined below) or jamuse Content through any technology or means other than the file view of the Website itself, or if explicitly authorized by individual Members, through jamuse Collaboration or file download.

D. You agree not to use the Website for any prohibited commercial use, without the prior written authorization of jamuse. Prohibited commercial uses include any of the following actions taken without jamuse's express approval:

sale of access to the Website or its related services on another website;
use of the Website or its related services for the primary purpose of gaining advertising or subscription revenue;
the sale of advertising, on the jamuse website or any third-party website, targeted to the content of specific Member Submissions or jamuse content;
and any use of the Website or its related services that jamuse finds, in its sole discretion, to use jamuse's resources or Member Submissions with the effect of competing with or displacing the market for jamuse, jamuse content, or its Member Submissions.

E. Prohibited commercial uses do not include:

uploading and/or maintaining original content of your business or artistic enterprise;
using jaMuse to show, showcase, transfer, or distribute files provided the primary purpose is not to compete with jamuse;
any use that jamuse expressly authorizes in writing.

F. You agree not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the Website in a manner that sends more request messages to the jamuse servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, jamuse grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. jamuse reserves the right to revoke these exceptions either generally or in specific cases.

G. You agree not to collect or harvest any personally identifiable information, including account names, from the Website, nor to use the communication systems provided by the Website (e.g. comments, email) for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any Members of the Website with respect to their Member Submissions.

H. You will otherwise comply with the terms and conditions of these Terms of Service, jamuse Community Guidelines, and all applicable local, national, and international laws and regulations.

I. jamuse reserves the right to discontinue any aspect of the jamuse Website at any time.

5. Your Use of Content on the Site

In addition to the general restrictions above, the following restrictions and conditions apply specifically to your use of content on the jamuse Website.

A. The content on the jamuse Website, except all Member Submissions (as defined below), including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to jamuse, subject to copyright and other intellectual property rights under the law. Content on the Website is provided to you AS IS for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. jamuse reserves all rights not expressly granted in and to the Website and the Content.

B. You may access Member Submissions solely:

for your information and personal use;
as intended through the normal functionality of the jamuse Service;
as intended for file sharing, collaboration, and/or transfer as authorized by Members; and
for Streaming.

"Streaming" means a contemporaneous digital transmission of an audiovisual work via the Internet from the jamuse Service to a Member's device in such a manner that the data is intended for real-time viewing and not intended to be copied, stored, permanently downloaded, or redistributed by the Member. Accessing Member Submissions for any purpose or in any manner other than Streaming, or unless authorized by the Member, is expressly prohibited.

C. Member Comments are made available to you for your information and personal use solely as intended through the normal functionality of the jamuse Service. Member Comments are made available "as is", and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, downloaded, or otherwise exploited in any manner not intended by the normal functionality of the jamuse Service or otherwise as prohibited under this Agreement.

D. You may access jamuse Content, Member Submissions and other content only as permitted under this Agreement. jamuse reserves all rights not expressly granted in and to the jamuse Content and the jamuse Service.

E. You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, including any use, copying, or distribution of Member Submissions obtained through the Website unless expressly authorized by the Member.

F. You agree not to circumvent, disable or otherwise interfere with security-related features of the jamuse Website or features that prevent or restrict use or copying of any Content or enforce limitations on use of the jamuse Website or the Content therein.

G. You understand that when using the jamuse Website, you will be exposed to Member Submissions from a variety of art, artistic, creative, marketing, advertising, and related sources, and that jamuse is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Member Submissions. You further understand and acknowledge that you may be exposed to Member Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against jamuse with respect thereto, and agree to indemnify and hold jamuse, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.

6. Your Member Submissions and Conduct

A. As a jamuse account holder (Member) you may submit content. Member file submissions Member comments are collectively referred to as "Member Submissions." You understand that whether or not such Member Submissions are published, jamuse does not guarantee any confidentiality with respect to any Member Submissions made publicly available on jamuse by posting to the jaMuse Community, or including in the Member Portfolio.

B. You shall be solely responsible for your own Member Submissions and the consequences of posting or publishing them. In connection with Member Submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorize jamuse to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Member Submissions to enable inclusion and use of the Member Submissions in the manner contemplated by the Website and these Terms of Service.

C. You retain all rights of ownership for any of your Member Submissions (i.e. work you voluntarily share in jamuse Community and/or your Profile). By submitting Member Submissions to jamuse, you grant jamuse the limited right to display such Member Submissions in Community and Member Portfolio. You also grant Members and visitors of the jamuse Website the right to VIEW Member Submission, as permitted through the functionality of the Website and under these Terms of Service.

In addition, you grant jamuse (and its successors' and affiliates') the right to use jamuse Home and Community website pages, in whole or in part, as they may contain Member Submissions, in its communication, marketing, advertising, promotions, and other business activities.

Nothing herein grants Members or visitors of jamuse the right to use, reproduce, copy, or otherwise manipulate your Member Submissions, except to VIEW, as permitted through the functionality of the jamuse Website and under these Terms of Service.

Further, you understand and agree, that jamuse may retain, but not display, distribute, or perform, server copies of Publicly Available Member Submissions that have been removed, deleted, or unlinked from the jamuse Community or Member Portfolio.

D. In connection with Member Submissions, you further agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant jamuse all of the license rights granted herein.

E. You agree that your conduct on the site will comport with the jamuse Community Guidelines, which may be updated from time to time.

F. jamuse does not endorse any Member Submission or any opinion, recommendation, or advice expressed therein, and jamuse expressly disclaims any and all liability in connection with Member Submissions. jamuse does not permit copyright infringing activities and infringement of intellectual property rights on its Website, and jamuse will remove all Content and Member Submissions if properly notified that such Content or Member Submission infringes on another's intellectual property rights.

G. jamuse reserves the right to remove Content and Member Submissions without prior notice if, in it’s sole determination, the Content and/or Member Submission violates any part of these Terms or Services.

7. Account Termination Policy

A. jamuse will terminate a Member's access to its Website if, under appropriate circumstances, they are determined to have significantly, or repeatedly violated these Terms of Services.

B. jamuse reserves the right to decide whether Content or a Member Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to, pornography, obscene or defamatory material, or the uploading, sharing, or distributing of third party electronic files, programs, and/or data. jamuse may remove such Member Submissions and/or terminate a Member's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.

8. Digital Millennium Copyright Act

A. If you are a copyright owner or an agent thereof and believe that any Member Submission or other content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;
Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail;
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

jamuse's designated Copyright Agent to receive notifications of claimed infringement is: Legal Dept, 230 Park Ave., 10^th Floor, New York, NY 10169, fax: 212-658-9432. For clarity, only DMCA notices should go to the Copyright Agent; any other feedback, comments, requests for technical support, and other communications should be directed to jamuse customer service through our live support. You acknowledge that if you fail to comply with all of the requirements of this Section 5(D), your DMCA notice may not be valid.

B. Counter-Notice. If you believe that your Member Submission that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the content in your Member Submission, you may send a counter-notice containing the following information to the Copyright Agent:

Your physical or electronic signature;
Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and
Your name, address, telephone number, and e-mail address, a statement that you consent to the jurisdiction of the federal court in San Francisco, California, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Copyright Agent, jamuse may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or Member, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at jamuse's sole discretion.

9. Warranty Disclaimer

YOU AGREE THAT YOUR USE OF THE JAMUSE WEBSITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, JAMUSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND YOUR USE THEREOF. JAMUSE MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SITE'S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS SITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE JAMUSE WEBSITE. JAMUSE DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE JAMUSE WEBSITE OR ANY HYPERLINKED WEBSITE OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND JAMUSE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. 10. Limitation of Liability

IN NO EVENT SHALL JAMUSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE JAMUSE WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

YOU SPECIFICALLY ACKNOWLEDGE THAT JAMUSE SHALL NOT BE LIABLE FOR MEMBER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

The Website is controlled and offered by jamuse from its facilities in the United States of America. jamuse makes no representations that the jamuse Website is appropriate or available for use in other locations. Those who access or use the jamuse Website from other jurisdictions do so at their own volition and are responsible for compliance with local law.

11. Indemnity

You agree to defend, indemnify and hold harmless jamuse, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the jamuse Website; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your Member Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the jamuse Website.

12. Ability to Accept Terms of Service

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. In any case, you affirm that you are over the age of 13, as the jamuse Website is not intended for children under 13. If you are under 13 years of age, then please do not use the jamuse Website.

13. Assignment

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by jamuse without restriction.

14. General

You agree that: (i) the jamuse Website shall be deemed solely based in Nevada; and (ii) the jamuse Website shall be deemed a passive website that does not give rise to personal jurisdiction over jamuse, either specific or general, in jurisdictions other than Nevada. These Terms of Service shall be governed by the internal substantive laws of the State of Nevada, without respect to its conflict of laws principles. Any claim or dispute between you and jamuse that arises in whole or in part from the jamuse Website shall be decided exclusively by a court of competent jurisdiction located in Washoe County, Nevada. These Terms of Service, together with the Privacy Notice and any other legal notices published by jamuse on the Website, shall constitute the entire agreement between you and jamuse concerning the jamuse Website. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and jamuse's failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. jamuse reserves the right to amend these Terms of Service at any time and without notice, and it is your responsibility to review these Terms of Service for any changes. Your use of the jamuse Website following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. YOU AND JAMUSE AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE JAMUSE WEBSITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. jamuse Privacy Notice

This policy describes specific privacy practices for how jaMuse and its subsidiaries treat personal information when you use jamuse services, including information provided when you use jamuse. To understand how we treat the information you give us as you use jamuse, you should read this policy.

Personal Information

Non-Account Activity. You can view jaMuse Community and Portfolio files made publicly available by Members without having a jamuse Member Account.
Account-Related Activity. Certain other activities on jamuse—like uploading files, having a Member Profile and Portfolio, using the Digital Asset Manager and/or Collaboration tool, posting comments, or viewing restricted files require you to have a jamuse Member Account. We ask for some personal information when you create a jamuse Account, including your email address and a password, which is used to protect your account from unauthorized access.
Usage Information. We may record information about your usage, such as when you use jamuse, the files you view, blogs, channels, forums, groups, Colleagues, and favorites you subscribe to, the contacts you communicate with, and the frequency and size of data transfers, as well as information you display or click on in jamuse. If you are logged in, we may associate that information with your account. We may use "Web Beacons" in HTML-based emails sent to our Members to track which emails are opened by recipients.
Content Uploaded to Site. Any personal information or file content that you voluntarily disclose online (on discussion boards, in messages and chat areas, within your profile pages, etc.) becomes publicly available and can be collected and used by others.

Uses

If you submit personally identifiable information to us through the jamuse Sites, we use your personal information to operate, maintain, and provide to you the features and functionality of the jamuse Sites, as well as provide special personalized features to you.
Your account name (not your email address) is displayed to other Members when you view Publicly Available Submissions, or send messages through the jamuse Sites, and other Members can contact you through messages and comments. Any Publicly Available Submissions that you submit to the jamuse Site may be redistributed through the internet and other media channels, and may be viewed by the general public.
We do not use your email address or other personally identifiable information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We may, however, use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major jamuse Site changes or for customer service purposes).
We use both your personally identifiable information and certain non-personally-identifiable information (such as anonymous Member usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the jamuse Sites and to create new features, promotions, functionality, and services by storing, tracking, and analyzing Member preferences and trends.
We use cookies, clear gifs, and log file information to: (a) store information so that you will not have to re-enter it during your visit or the next time you visit the jamuse Sites; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests.

Your Choices

You may, of course, decline to submit personally identifiable information through the jamuse Sites, in which case you can still view Publicly Available Submissions, including Community and Portfolio files, and explore the jamuse Sites, but jamuse may not be able to provide certain services to you. The privacy notices of those services govern the use of your personal information associated with them.
You may update or correct your personal profile information and email preferences at any time by visiting your Member Profile.

Respect the Jamuse Community

As a community for creative talent, we recognize and support freedom of expression. We ask that Members use their best judgment in determining the appropriateness of images, videos, audio, and other files to be shared in the Community and Member portfolio, for all other Members and visitors to view or hear. Participating in the jaMuse Community involves a certain level of trust between jaMuse, Members, and Visitors. We trust Members to be responsible, and we trust the Community at large to help determine if/when a submission is inappropriate for Public Availability.

We Review Submissions Flagged As Inappropriate

JaMuse reviews all Publicly Available Submissions flagged as inappropriate to determine whether it violates these Terms of Services. Flagged submissions are not automatically taken down by the system. If we remove, delete, or unlink your file from the Community of your Portfolio after reviewing it, you can assume that we took such action purposefully, and you should take our warning notification seriously. If you find other videos on Jamuse with the same violations, please flag them so we can review them as well!

Balancing Freedom of Expression with Inappropriateness

Here are some common-sense rules that will help you and other Members create a Community worthy of membership by other creative professionals:

jamuse is not for pornography or non-artistic sexually explicit content. If this describes your files, do not post or submit them on Jamuse. We will rely, in part, but not solely, on the jaMuse Community to flag as inappropriate work/files of a sexual content that are determined to be non-artistic. Also, be advised that we cooperate with law enforcement and report child exploitation.
jaMuse is not for dangerous or illegal acts, like animal abuse, drug abuse, or bomb making. We will rely, in part, but not solely, on the jaMuse Community to flag as inappropriate work/files depicting dangerous or illegal acts that are determined to be non-artistic. Also, be advised that we cooperate with law enforcement and report serious illegal acts.
jaMuse is not for graphic or gratuitous violence. If this describes your files, do not post or submit them on Jamuse.
Respect copyrights. Only upload files of your own creation, or for which you have obtained the rights to use. Do not upload for public availability in the Community or your Portfolio work someone else owns the copyright to, such as photographs, art work, images, music tracks, videos, etc., without the the copyright owner’s permission.
jaMuse is not for hate speech. Although we encourage free speech and defend everyone's right to express unpopular points of view, we do not permit hate speech which contains slurs or the malicious use of stereotypes intended to attack or demean a particular gender, sexual orientation, race, religion, or nationality.
There is zero tolerance for predatory behavior, stalking, threats, harassment, invading privacy, or the revealing of other members' personal information. Doing so may result in the offender being permanently banned from jamuse.
Do not try to circumvent these Terms of Services. JaMuse does not permit gamed thumbnails, spamming tags, or creating dummy accounts that do things a human wouldn't do.

Violations of the Terms of ervices may result in a warning notification or may result in termination of your Member account and deletion of all your files. We decide, at our sole discretion, whether we believe your violation of our Terms of Services should result in termination of your account. If you have an account terminated you are prohibited from ever signing up for another account!
